There are generally two types of personal bankruptcy that individuals may be able to file:

  • Chapter 7 — Also known as liquidation bankruptcy, a person filing Chapter 7 will discharge all of his or her unsecured debts, such as credit card charges, personal loans, or medical bills. However, secured debts such as mortgages or car loans will not be discharged. The process generally takes only four to six months, but the individual will first need to pass the bankruptcy means test to determine whether he or she is eligible.
  • Chapter 13 — This is a reorganization bankruptcy in which some of the individual pays back all or a portion of his or debts over a three to five year period. Under this plan, a person only pays back what he or she can afford. An individual could also be able to remove a second mortgage while still saving his or her home from foreclosure.
